Welcome to S.T.A.R.™! These Terms of Use (or “Terms”) govern Your use of S.T.A.R.™, except where we expressly state that separate terms (and not these) apply and provide information about S.T.A.R.™ Service (the Service), outlined below.

The S.T.A.R.™ Service is one of the E.Y.T. products, provided to you by Engage Your Team LLC. These Terms of Use therefore constitute an agreement between you and E.Y.T. LLC.

ARBITRATION NOTICE: YOU AGREE THAT DISPUTES BETWEEN YOU AND US WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION AND YOU WAVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITE OR CLASS-WIDE ARBITRATION. WE EXPLAIN HOW YOU CAN OPT OUT OF ARBITRATION BELOW.

The S.T.A.R.™ SERVICE

We agree to provide you with the S.T.A.R.™ SERVICE. The Service includes all S.T.A.R.™ products, applications, services, technologies, and software that we provide to advance the Engage Your Team LLC mission: to bring your professional engagement closer to business performance objectives and career requirements. The service is made up of the following aspects:

• Offering employee performance assessments to create, connect, communicate, discover employee's engagement strategy at all levels of employment, and cross-collaboration in HR & Operations areas from your employee perspective.
• Employees at all levels of employment have different performance objectives to meet. So, we offer strategy reports for gap analysis to help identify areas in HR & Operations which needs improvement and strategies to assure that organizational goals are met, customer service and sales goals, and identify teams' cross collaboration for meeting your company strategic and tactical objectives. We also want to strengthen your engagement with other employees' and executives to improve shared goals; for development potentials and career mapping. SoTherefore, we build systems that try to understand how you engage and care about meeting business goals and use this information to create strategies that can be easily deployed by your internal team, and to experience performance results rather than seeking the strategy that is costly and time consuming.
• To foster employee engagement: and a performance commitment to organization goals and objectives, we develop and use business performance assessment tools andthat offers resources for business management that helps to make their working experiences positive and inclusive., It includsing organization performance improvements that affect the bottom line.
• We use all information we gather - including your information - and keep our online assessments secure.

Your access to and use of the S.T.A.R.™ Online Assessment program is subject exclusively to these Terms and Conditions. You will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website, you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions, you must immediately stop using the Website.

Credit Card Details
Engage Your Team, LLC does not offer direct sales of assessments online and therefore does not ask for Credit Card payments through the S.T.A.R.™ Online Assessment program interface. We request that you do not enter it on any of the forms within the S.T.A.R.™ Online Assessment program.

Advice
The contents of the S.T.A.R.™ Online Assessment program website does not constitute advice and should not be relied upon without consultation in making or refraining from making, any decision.

Change of Use
Engage Your Team, LLC. reserves the right to:

• Change or remove (temporarily or permanently) the S.T.A.R.™ Online Assessment program or any part of it without notice and you confirm that Engage Your Team, LLC. shall not be liable to you for any such change or removal.
• Change these Terms and Conditions at any time, and your continued use of the S.T.A.R.™ Online Assessment program following any changes shall be deemed to be your acceptance of such change.

The S.T.A.R.™ Online Assessment program website may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that we are not responsible for the content or availability of any such sites.

Disclaimers and Limitation of Liability
The S.T.A.R.™ Online Assessment program is provided on an AS IS and AS AVAILABLE basis without any representation or endorsement made and without warranty of any kind whether express or implied, including, but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security, and accuracy.

To the extent permitted by law, Engage Your Team, LLC. will not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the S.T.A.R Online Assessment program.

Engage Your Team, LLC. makes no warranty that the functionality of the S.T.A.R.™ Online Assessment program will be uninterrupted or error free, that defects will be corrected or that the S.T.A.R.™ Online Assessment program or the server that makes it available are free of viruses or anything else which may be harmful or destructive.

Indemnity
You agree to indemnify and hold Engage Your Team, LLC and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against Engage Your Team, LLC arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of the S.T.A.R.™ Online Assessment program.

Severance
If any of these Terms and Conditions should be determined to be invalid, illegal, or unenforceable for any reason by any court of competent authority then such Term or Condition shall be severed, and the remaining Terms and Conditions shall survive and remain in full force, effect, and continue to be binding and enforceable.

Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Michigan and with the laws of the United States of America and you hereby submit to the exclusive authority of the Michigan courts.
